California - AB 3030 Generative AI in Health Care Communications (2024)

Enacted in 2024 and effective 1 January 2025, AB 3030 adds requirements to the California Health and Safety Code for the use of generative artificial intelligence in patient communications. It applies to health facilities, clinics, physician offices and group practices that use generative AI to generate written or verbal communications to a patient concerning the patient's clinical information. The law is designed to preserve transparency and the patient's ability to reach a human clinician as AI-generated messaging becomes more common in health care.

Covered communications must include a disclaimer indicating that the communication was generated by artificial intelligence, and clear instructions describing how the patient may contact a human health-care provider, employee or other appropriate person. The requirement does not apply where a licensed or certified health-care provider reads and reviews the AI-generated communication before it is sent. Enforcement runs through the applicable licensing entities, including the California Department of Public Health and the relevant professional boards.
