Utah's AI Policy Act requires disclosure of generative-AI use in consumer interactions (proactively for regulated occupations), creates an Office of AI Policy and a regulatory sandbox, and adds mental-health chatbot rules via HB 452.
Enacted in March 2024 and effective 1 May 2024, the Utah Artificial Intelligence Policy Act was the first US state AI consumer-protection statute of its kind. It provides that a person who uses generative AI to interact with a person in connection with a regulated occupation must proactively and clearly disclose that the person is interacting with generative AI, while other entities must clearly and conspicuously disclose the use of generative AI if a consumer asks. It also confirms that a defendant cannot avoid liability under Utah consumer-protection law by attributing offending statements to generative AI. The Act created the Office of Artificial Intelligence Policy and an AI Learning Laboratory regulatory sandbox.
The Act was refined in 2025 by SB 226 and SB 332, which narrowed the generative-AI disclosure triggers and extended the Learning Lab. Separately, HB 452, effective in May 2025, regulates mental-health chatbots: suppliers must disclose that a user is interacting with AI rather than a human, restrict advertising within chatbot conversations, and limit the sale or sharing of users' health information. Enforcement is by the Utah Division of Consumer Protection, with administrative and court-ordered penalties.
A person using generative AI to interact with consumers in a regulated occupation must proactively and clearly disclose that the interaction involves generative AI.
Other entities must clearly and conspicuously disclose the use of generative AI when asked by a consumer.
A defendant cannot escape consumer-protection liability by attributing offending statements or conduct to generative AI.
Suppliers of mental-health chatbots must disclose that the user is interacting with AI, restrict in-conversation advertising, and limit the sale or sharing of user health data.
